These Terms of Service (“Terms”) govern your use of BeAChallenger, an independent hobby project operated by an individual creator (“we”, “us”, “our”), including our website, mobile application, and related services (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must:

• Be at least 16 years old
• Be legally capable of entering into a binding agreement under laws that apply to you

By using the Service, you confirm that you meet these requirements.

3. Your Account

You are responsible for:

• Keeping your login details secure
• All activity carried out through your account

You must notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts where there is misuse, breach of these Terms, or security risk.

4. User Content & Submissions

You may submit content including:

• Scores and activity data
• Profile information
• Images or videos (if required for moderation)

By submitting content, you confirm that:

• The content is accurate to the best of your knowledge
• You have the right to submit it
• It does not infringe third-party rights or break the law

You grant us a non-exclusive, royalty-free, limited licence to use your content solely for operating, displaying, and moderating the Service.

We reserve the right to:

• Review submissions
• Approve or reject content
• Remove content that breaches these Terms

5. Health & Fitness Disclaimer (Very Important)

The Service is provided for informational and competitive purposes only.

• We do not provide medical, health, or fitness advice
• Participation in physical activity carries inherent risks
• You are solely responsible for your health and safety

You should consult a qualified professional before engaging in strenuous exercise.

6. Leaderboards, Communities & Rankings

• Scores and rankings are user-submitted and may not be independently verified
• Rankings are provided “as displayed” and may change at any time
• We do not guarantee accuracy, fairness, or availability of any leaderboard

Communities and leaderboards may be public or private. Access rules are set by the platform and/or community administrators.

7. Prohibited Use

You must not:

• Submit false, misleading, or fraudulent data
• Attempt to manipulate leaderboards or rankings
• Harass, abuse, or threaten others
• Circumvent security, moderation, or access controls
• Use the Service for unlawful purposes

We may take action including suspension or termination if these rules are breached.

8. Suspension & Termination

You may stop using the Service at any time.

We may suspend or terminate access:

• If these Terms are breached
• To protect users or the integrity of the Service
• Where required by law

Where reasonable, we will provide notice.

9. Intellectual Property

All intellectual property rights in the Service (excluding user content) belong to Be a Challenger.

You may not copy, modify, distribute, or reverse-engineer any part of the Service without permission.

10. Availability & Changes

We do not guarantee uninterrupted access to the Service.

We may update, suspend, or withdraw features at any time.

Material changes to these Terms will be communicated where required by law.

11. Subscriptions & Billing

• Pro subscriptions are processed by Apple In-App Purchase on iOS.
• Subscriptions auto-renew unless cancelled in your Apple ID subscription settings.
• Prices and billing periods are shown before purchase and may change for future renewals where allowed by law.
• Refunds are handled by Apple under Apple Media Services policies.

12. Liability

Nothing in these Terms limits or excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable law

Subject to the above:

• We are not liable for indirect or consequential loss
• We are not responsible for user-generated content
• Use of the Service is at your own risk

13. Consumer Rights

Nothing in these Terms affects your statutory rights under applicable consumer law.

14. Governing Law & Jurisdiction

These Terms are interpreted in line with mandatory consumer and privacy laws that apply to your place of residence.

Where mandatory law does not specify otherwise, disputes will be handled under the jurisdiction of the operator’s local courts.
